Without prejudice to the foregoing, you agree that, in its sole discretion, Travel & Payment Site may also bring any claim that we might have against you related to efforts to abuse, interfere, or engage with our products in an unauthorized way in the country in which you reside that has jurisdiction over the claim.

To the extent permitted by law, the total liability of Travel & Payment Site, and its subsidiaries, for any claims under these terms, including for any implied warranties, is limited to the amount you have paid us to use the Services (or, if we choose, to supply you the services again).

In no event will Travel & Payment Site be liable for any special, incidental, indirect, or consequential damages whatsoever arising from your access or use of, or inability to access or use, the Services.

10. Injunctive Relief

The parties to this Terms of Use acknowledge that a violation of any of the provisions of this Terms of Use would cause immediate and irreparable harm to the company for which monetary damages would be inadequate. Therefore, the Company shall be entitled to injunctive relief for the breach of any obligation by the You without proof of actual damages. Such remedy shall not be deemed to be the exclusive remedy for such violation but shall be in addition to all other remedies available at law or in equity.

11. Indemnification

Notwithstanding anything to the contrary, you hereby undertake to indemnify and keep indemnified its Founders, Co-Founders, directors, employees, and agents, if any, against all claims, demands, damages, penalties, costs, or expenses of any kind whatsoever, which may arise against or be incurred by you in connection with any action/omission on their part pursuant to or in connection with this Document and/or arising by an act, default or neglect of you or otherwise arising out of any breach of any of the provisions, undertakings, representations and warranties and covenants of this Terms of Use.

12. Amendment or Waiver

Any amendment or waiver to our agreement must be in writing and signed by us. If we fail to enforce any aspect of this agreement, it will not be a waiver.

13. Governing Laws

These Terms of Use shall be governed by and construed in accordance with the laws of Singapore, without giving effect to any principles of conflicts of law. Any dispute arising under or in connection with this Terms of use shall be resolved exclusively in the courts of Singapore. You hereby irrevocably consent to the jurisdiction and venue of such courts for any such dispute and waive any objections to such jurisdiction or venue.
